The Canada Shipping Act, 2001 and its supporting sections set the rules, and Transport Canada enforces them through plan review, inspection, and registration. Fix the Rule Set Before Design Begins

Every vessel is measured against a specific set of regulations. Confirm which set applies before any drawing is issued, because that decision shapes everything that follows. The answer depends on the length of the hull, its gross tonnage, and the work it will do.

New vessels of 24 metres or more fall under the Vessel Construction and Equipment Regulations, which came into force in December 2023. These regulations gather structural strength, stability, machinery, electrical systems, fire protection, lifesaving equipment, and crew accommodation into one place. Transport Canada states plainly that they do not apply to fishing vessels or pleasure craft. A ship carrying passengers picks up further sections covering escape routes and watertight subdivision.

Smaller boats follow a different track. Vessels of not more than 15 gross tonnage fall under the Small Vessel Regulations, with the technical detail set out in Construction Standards for Small Vessels, TP 1332. Owners often assume the Small Vessel Regulations are easier. Structurally they are. The crew and equipment obligations are not. Fishing vessels sit outside both frameworks and follow the Fishing Vessel Safety Regulations. Choosing the wrong rule set is the most expensive mistake on the list. A hull designed against the wrong sections can need structural rework after fabrication has started. Paperwork cannot fix a hull built to the wrong standard.

Plan Approval and the Authorized Representative

Every Canadian vessel must have an authorized representative. This is the person or company legally accountable for compliance. Transport Canada writes to the authorized representative rather than the builder, so naming one early keeps the file moving.

Drawings then go to Transport Canada or a recognized organization under the Canadian Vessel Plan Approval and Inspection Standard. The reviewer checks each drawing against the construction regulations that apply to the vessel. Three submissions carry the most weight:

  • Structural plans, covering scantlings, framing, plating, and hull sections
  • Stability and buoyancy calculations, proving the vessel stays safe in every loading condition
  • Machinery and systems plans, covering propulsion, piping, steering, and fire protection

Equipment manufacturers supply type approval certificates for lifesaving gear, navigation lights, and fire pumps. Some manufacturers take months to release them, so gather these during procurement rather than at delivery. The authorized representative then confirms that every item fitted on board matches what was approved. Safety Certificates and the Inspection Path

Approval produces the paperwork a vessel cannot sail without. Ships on international voyages fall under the SOLAS Convention, and each chapter of that Safety Convention sets its own equipment and survey obligations. Transport Canada issues Vessel Safety Certificates under the Vessel Safety Certificates Regulations, with inspection types and certificate periodicity harmonized to the IMO Harmonized System of Survey and Certification. That system lines up renewal dates so surveys happen together instead of scattered through the year.

Vessel Safety Certificates stay valid only while the ship matches the condition that was surveyed. Change the vessel and the certificate is at risk.

Canadian vessels working domestically follow a lighter path than ships trading abroad. The Safety Convention still shapes the standards, so the relevant chapter is worth reading before the general arrangement is locked. Foreign vessels calling at Canadian ports face the same Safety Convention benchmarks through port state control. Foreign vessels detained there work through the same corrective sections a domestic operator would.

Owners of Canadian vessels should expect Vessel Safety Certificates to be reviewed at every renewal survey, and should budget for a surveyor attending the yard. Vessel Safety Certificates issued against the Safety Convention are recognized by port authorities abroad, which matters to anyone planning foreign work. The SOLAS Convention timetable does not move, so a late build can push a certificate date.

Small Commercial Vessels

Smaller hulls carry a different mix of paperwork, and crew certification often matters more than structural approval. Operators need SVOP training, and radio operators need ROC-M certification before the vessel enters service.

The common crew documents are:

  1. SVOP, the small vessel operator proficiency certificate
  2. ROC-M, the restricted operator certificate for maritime radio
  3. Marine Basic First Aid and marine emergency duties training

Course seats fill up quickly. Book SVOP and ROC-M months ahead so a finished vessel is not sitting idle waiting on a crew. Capacity labels must also be fitted and correct before passengers board.

Crew Accommodation Standards

Canadian vessels with crew living on board must meet the crew accommodation requirements set out in Part 2 of the Vessel Construction and Equipment Regulations. That part reaches Canadian vessels of every size, so it applies to a small workboat as well as a large ship. Accommodation spaces affect the general arrangement, so they belong in the first layout discussion rather than a late fit out. A vessel designed without those clearances can lose usable working deck once the accommodation is corrected. Vessels of 500 gross tonnage or more on an international voyage, other than an inland voyage, also need a Maritime Labour Certificate. Inspectors judge what is fitted on board, not what the drawings promised.

Registration and the Vessel Register

A commercial vessel must be entered in the Canadian Register of Vessels. A pleasure craft licence does not count. Larger commercial hulls sit in the Large Vessel Register, and that Large Vessel Register entry establishes title, mortgage priority, and nationality for the ship.

File the application forms during construction, not after launch. Owners usually prepare:

  • Proof of vessel ownership and Canadian qualification to own a registered ship
  • A builder’s certificate naming who built the hull and when
  • Vessel tonnage measured by an authorized measurer
  • The chosen port of registry, which is marked on the stern
  • Basic particulars, including the make and model of the vessel

Reserving the name early protects the record and lets signage and documents proceed while fabrication continues. The port of registry is permanent in practice, so choose it deliberately.

Operating Conditions That Change the Package

Intended service changes what certification involves. A hull working in ice conditions needs strengthened framing, protected sea chests, and machinery rated for cold operation. Those features belong in the approved sections of the drawings, not in a later change order. Reviewers treat ice strengthening as a design feature rather than an accessory.

Search and Rescue craft carry recovery equipment, medical space, and towing capability, and each addition brings its own review item. Every vessel must also meet the Collision Regulations for lights, shapes, and sound signals. That sounds routine until a custom wheelhouse blocks a required arc of visibility.

Before construction starts, put a certification agreement in place with the yard naming who files what and by when. That one document prevents the common failure where each party assumes the other is handling it.
